FIG ATELIER TERMS & CONDITIONS

1. Introduction

These Terms and Conditions govern the sale of goods by Fig Atelier (“the Company”) to the customer (“the Customer”). By placing an order, the Customer agrees to be bound by these Terms.

These Terms do not affect your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

2. Products & Description

Fig Atelier supplies furniture and interior products sourced from a range of European manufacturers.

All product descriptions, images, and specifications are provided as accurately as possible. However, variations may occur due to natural materials (such as wood, leather, marble and stone), fabric dye batches, handcrafted production processes, and screen display differences.

Many of our products are made using natural and artisanal materials, which may display variations, irregularities, markings, and tonal differences. These characteristics are inherent to the material and form part of the product’s natural beauty and individuality.

Such variations are not considered faults or defects.

3. Made-to-Order Furniture (Luxury Furniture Edit)

All furniture within the Luxury Furniture Edit is made to order.

These items are non-cancellable, non-returnable, and non-refundable once production has commenced, except where:

  • The item is faulty or defective; or
  • The item does not match the agreed specification (for example, incorrect dimension or finish).

The Customer is responsible for approving all specifications prior to order.

4. Standard Goods (Linear Edit & Accessories)

Standard goods may include wallpapers, cushions and pre-made cushions, throws, paint, and standard-size rugs.

These items may be eligible for return in accordance with the Refund & Returns Policy. Where goods are returned due to a change of mind, manufacturer-led restocking fees may apply.

5. Ex-Display Items

Ex-display and sample items may show signs of use. Customers will be provided with images and/or video prior to dispatch, or may inspect the item in person.

By proceeding with the purchase, the Customer confirms acceptance of the item’s condition.

These items are sold as seen and are non-returnable and non-refundable in respect of cosmetic wear or imperfections disclosed prior to sale.

Returns will only be considered where the item is structurally faulty or materially different from the condition presented prior to sale.

6. Pricing & Payment

Prices are as stated at the time of order. Prices may be subject to change prior to order confirmation.

Full payment is required before goods are dispatched.

Ownership of goods passes to the Customer once payment has been received in full and delivery has taken place.

6A. Pricing & Description Errors

While every effort is made to ensure accuracy, errors may occasionally occur, including incorrect pricing or product descriptions.

Fig Atelier reserves the right to correct any such errors and to cancel or refuse any order placed where an error has occurred.

In such cases, the Customer will be notified and any payments made will be refunded in full.

7. Lead Times

All lead times are estimates only. Delays may occur due to manufacturing, supplier schedules, or transport logistics.

Fig Atelier is not liable for delays outside of its control.

8. Delivery

8.1 Luxury Made-to-Order and Display Pieces

Luxury made-to-order and display items are delivered via a specialist furniture courier service. This includes delivery, unpacking, and a condition check at the point of delivery.

The courier will inspect the item with the Customer and obtain a signed confirmation of condition. By signing, the Customer confirms that the item has been received in satisfactory condition.

Any visible damage must be reported and noted at the time of delivery. Claims made after this point may not be accepted.

If no one is present to inspect and sign for the goods, Fig Atelier cannot accept responsibility for visible damage claims that would have been identified at the time of delivery.

Any damage not visible at the time of delivery (concealed damage) must be reported within 48 hours of receipt. Claims made after this period may not be accepted.

8.2 Delivery Charges – Luxury Items

A standard £200 base delivery fee applies to luxury made-to-order and display pieces.

Final delivery costs are subject to confirmation based on cubic volume, weight, delivery location, and access requirements.

Any additional charges will be confirmed with the Customer and must be agreed prior to dispatch.

8.3 Linear Edit & Standard Delivery

Items within the Linear Edit and other standard goods may be delivered via standard courier services and may require light assembly.

Customers are responsible for inspecting goods upon receipt and should report any issues as soon as possible, ideally within 7 days.

8.4 Free Delivery

Free delivery promotions apply to UK mainland addresses only and to selected standard goods.

Free delivery does not apply to luxury made-to-order or display items.

Fig Atelier reserves the right to apply delivery charges where orders exceed reasonable volume or handling requirements. Customers will be notified of any such charges prior to dispatch.

9. Access, Measurement & Delivery Responsibility

It is the Customer’s responsibility to ensure that items will fit into the property. This includes checking doorways, hallways, staircases, and access routes.

Customers are encouraged to refer to the Fig Atelier Measuring Guide prior to purchase.

Where delivery cannot be completed due to access restrictions, the Customer may be liable for redelivery, storage, and return transport costs.

Large or heavy items may require additional manpower or specialist handling, which may incur additional charges.

10. Storage & Delivery Delays

If delivery is delayed at the Customer’s request, Fig Atelier reserves the right to charge for storage and handling.

11. Refusal of Delivery

If delivery is refused (other than due to faults), the Customer will be responsible for return, storage, and handling costs.

12. Delivery Address Accuracy

The Customer is responsible for ensuring that all delivery details are accurate. Any costs arising from incorrect information will be chargeable.

13. Installation & Assembly

Delivery services may include placement and basic assembly only.

Fig Atelier is not responsible for structural alterations, electrical installation, or wall fixing.

14. Warranty

All products are supplied with a manufacturer’s warranty.

Warranty terms vary by brand and product. Warranty information is available upon request or provided with the product.

The warranty covers manufacturing faults only and does not extend to misuse, accidental damage, or general wear and tear.

15. Third-Party Suppliers

Products are supplied by third-party manufacturers.

Fig Atelier is not liable for supplier delays or manufacturing variations but will liaise with suppliers on the Customer’s behalf where required.

16. Use of Goods

Products must be used for their intended purpose. Fig Atelier is not liable for damage caused by misuse or inappropriate use.

17. Liability

Fig Atelier shall not be liable for indirect or consequential losses, delays outside its control, or third-party supplier or courier issues.

Nothing in these Terms excludes liability where it is unlawful to do so.

18. Force Majeure

Fig Atelier shall not be held liable for failure or delay due to circumstances beyond its control.

19. Jurisdiction

These Terms are governed by the laws of England and Wales.

20. Amendments

Fig Atelier reserves the right to update these Terms at any time.
